1. About this policy

Axis Fusion Holdings Pty Ltd (ABN 91 699 420 249, ACN 699 420 249) (we, us, our) is an Australian company registered in Western Australia. We respect your privacy and are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in that Act.

This policy explains what personal information we collect, why we collect it, how we hold and use it, when we disclose it, and how you can access it, correct it or make a complaint. It applies to this website, axisfusionholdingstec.site, and to the enquiries and correspondence we receive.

2. What personal information we collect

We collect only the personal information reasonably necessary for our functions and activities as a holding company. Depending on your dealings with us, this may include:

your name and the name of the business you represent;
your email address and any other contact details you choose to give us;
your role or position, and your relationship to the business you are enquiring about;
the content of your enquiry and any subsequent correspondence with us;
where a discussion progresses, commercial and financial information about a business, which may incidentally include personal information about owners, directors or key personnel.

We do not seek sensitive information as defined in the Privacy Act, and we ask that you do not send it to us unsolicited. If we receive sensitive information we did not request and it is not reasonably necessary for our functions, we will destroy or de-identify it as soon as practicable, as APP 4 requires.

3. How we collect personal information

Wherever it is reasonable and practicable to do so, we collect personal information directly from you — when you email us, complete the enquiry form on our contact page, or speak with a director.

The enquiry form on this website does not transmit anything to us or to any third party by itself. It opens a message in your own email application, which you then choose to send. Nothing you type into that form reaches us unless you send the resulting email.

In some cases we collect information about a business or its personnel from third parties, such as an accountant, a broker or a legal adviser acting for you, or from publicly available registers. Where we do so and the information is about you, we will take reasonable steps to make you aware of the collection in accordance with APP 5.

4. Why we collect, hold and use it

We use personal information for the purposes for which it was collected, and for related purposes you would reasonably expect. Those purposes are:

responding to your enquiry and corresponding with you about it;
assessing a potential acquisition, investment, joint venture or funding arrangement;
conducting due diligence and negotiating and documenting a transaction;
administering our relationship with the companies, advisers and counterparties we deal with;
meeting our obligations under the Corporations Act 2001 (Cth), taxation law and other applicable Australian laws.

We do not use personal information for direct marketing, we do not send unsolicited commercial email, and we do not sell, rent or trade personal information to anyone.

5. Cookies and website analytics

This website is a set of static pages. It does not set cookies, it does not use analytics, advertising, tracking pixels or social media plugins, and it does not load fonts, scripts or images from third-party servers. You can browse it without any information about you being collected by us through the site itself.

Our hosting provider may record standard technical server logs, such as IP addresses and requested pages, for security and network operation. We do not use those logs to identify individual visitors.

6. Disclosure of personal information

We treat commercial enquiries as confidential. We disclose personal information only where it is necessary and permitted, including to:

our professional advisers, such as accountants, auditors and lawyers, who are bound by confidentiality;
service providers who assist us with email, document storage and information technology;
a counterparty or co-investor, where you have agreed to that disclosure as part of a transaction;
a court, regulator or government agency where we are required or authorised by law to do so.

7. Overseas disclosure

We hold personal information in Australia wherever practicable. Some of the technology services we use, including email and cloud document storage, may store or process data on servers located outside Australia. Before disclosing personal information to an overseas recipient we take reasonable steps, as required by APP 8, to ensure the recipient does not breach the Australian Privacy Principles in relation to that information.

8. Security of personal information

We take reasonable steps to protect the personal information we hold from misuse, interference and loss, and from unauthorised access, modification or disclosure. Those steps include restricting access to the directors and personnel who need it, using access-controlled systems and reputable providers, and securely destroying or de-identifying records we no longer need.

No method of transmission over the internet is completely secure. Email in particular is not a secure channel, and we recommend you do not send highly confidential material by unencrypted email until we have agreed a suitable arrangement with you.

9. How long we keep it

We keep personal information only for as long as we need it for the purpose it was collected, or for as long as we are required to keep it by law. Enquiries that do not progress are retained for a reasonable period so that we can recognise later contact from you, and are then destroyed or de-identified. Records connected with a completed transaction are retained for the periods required under the Corporations Act 2001 (Cth) and taxation law, which are generally at least seven years.

10. Accessing and correcting your information

Under APP 12 and APP 13 you may ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.

Send your request to [email protected]. We will ask you to verify your identity and will respond within a reasonable period, ordinarily within 30 days. Access is free, although we may charge a reasonable amount for the cost of giving access where a request is extensive. If we refuse access or a correction, we will tell you in writing why, and how you may complain.

11. Complaints

If you believe we have breached the Australian Privacy Principles or otherwise mishandled your personal information, please tell us first. Write to [email protected] with the words “Privacy complaint” in the subject line, setting out what happened and what you would like us to do.

A director will acknowledge your complaint, investigate it and respond in writing, ordinarily within 30 days. If we need longer we will tell you why and when you can expect an answer.

If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC), which oversees the Privacy Act. The OAIC can be contacted at oaic.gov.au, by telephone on 1300 363 992, or by writing to GPO Box 5218, Sydney NSW 2001.

12. Changes to this policy

We may update this policy from time to time to reflect changes in our practices or in the law. The current version is always the one published on this page, and the date it was last updated is shown at the top. Material changes will be reflected in that date, so please check back if you rely on this policy.
